I haven't read the consultation in full but I haven't read in any review that the issue of registration has been raised. I was admitted 29 years ago and I have come to the firm conclusion that a Will is actually a fragile document. We deal mainly in a world where clients make wills, they die and the family come to us and the estate is administered in accordance with the Will. BUT what if there is a homemade will or a later will, what if a disappointed beneficiary finds the Will, reads it , and the destroys it. Who would know? What if a later will is simply overlooked? We all receive countless calls of people searching desperately for Wills. I think that there is a good argument to have a compulsory registration procedure. The present Certainty register is not adequate because it is voluntary. Just an idea, what do others think?
