So the medical professionals who caused the original problem are blameless ? They haven't contributed at all to this problem ?

This is all the fault of greedy ambulance chasing lawyers again.

I'm the first to accept that some standards have diminished since advertising was first introduced but I don't accept the blanket proposition that Claimant lawyers are to blame.

Courts have the power to reduce costs where appropriate and indeed they regularly do so. It's not as if Claimant lawyers can get away with charging whatever they like. The Defendants employ highly skilled costs consultants who are adept at reducing fees. This is not a case of Claimant lawyers railroading them and charging whatever they want.

Analogy : If I go to a shoe-shop and buy shoes which are faulty (but the shop doesn't admit fault), in default of a settlement I sue. I win. But hang on, the costs of the process (over which I have little if any control) are excessive and this is all my fault !

Let's face it we are fighting a losing battle here. Anyone who has ever handled a clinical negligence claim (or anyone like me who has spent 20+ years reading hundreds of clinical negligence files) will know that if (using the shoe-shop analogy) the shoe-shop said "sorry, the shoes are faulty - it's our fault, we'll rectify the situation immediately and satisfactorily", we wouldn't have the problem that we have now.
