The preference point never occurred to me; all of the articles I have read would suggest that one of the older brother's paid the money back from his own funds. If this is the case and if the payment is not to be considered a preference, is there scope for creditors to argue that this conduct is evidence that the company funds and personal funds of the directors are fluid...my knowledge in this area is limited.
