May I, as someone considered quite old, add my comments.
1. There was a time, many years ago, when a letter posted one day, other than Saturday, would be delivered the following day. I have a letter posted in England in 1925 and delivered in Ireland the following day.
2. Unfortunately that standard of service ceased and post was delivered whenever it was delivered. Many times there were a number of days elapsing between posting and delivery. This caused problems when the service of court documents had to be proved.
3. The Court Rules as to service were changed to provide service of documents was deemed to have taken place on a certain date after proof of posting or delivery. Those of us who are. like me, quite old, have no difficulty in understanding the procedure. The Rules are not difficult to understand. Of course this presupposes one is prepared to try to understand the reason for the Rule and, unfortunately, there are many slap happy firms who are so disorganized because their sole purpose in life is to rake in huge amounts of money they do not keep a log of the times which are going to have to be met. It is essential in litigation to diarise the relevant dates at the beginning of accepting instructions and abide by them. That way the type of situation under discussion would not arise - at least it never did in my fifty plus years in the law.
