Really anon @14.47. maybe the regulator itself is the problem. It should regulate without fear or favour but it does not. Until it starts being principled in its approach to regulation it will not be effective. Until it starts learning from and accepting it's mistake it will not be effective. The SRA is disfunctional and unfit for purposes, which is a shame. They need to sort out their internal runnings first and foremost, review whether those in post are fit for purpose and they need to employ more experienced solicitors in certain roles who actually understand the profession. Once they get their house in order they will be able to have meaningful and considered debate about things like the burden of proof. They after all were not without fault in the way they presented their case, this from a regulator, who should in theory be beyond reproach. The end does not justify the means. The SRA have had it too easy for too long and when someone has the resources to put up a fight, can't cope. They are like a spoilt child who gets a rude awakening when they enter the outside world and realised all does not revolve around them. As for TLS they should never have sat back quietly, as things got so bad
