I would hope that Hoskins is never applied to firms of solicitors or sets of any qualified lawyers. Members of the public should have absolute freedom to consult any lawyer they wish. These sorts of restrictive covenants for lawyers should be unenforceable and the SRA needs to rule on them. If there is skulduggery such as nicking client lists and such like these actions would be actionable. A lawyer should be free to move &engage with any client of his/her former firm who wants his/her service. We are professional people so lets behave as such.
