Why on earth has not happened before. Dealing with a LIP is difficult enough without the J making an Order based upon a letter we have not seen. In one case we received, out of the blue, a lenghty judgment dismissing our client's claim based on an unseen informal applicaiton made by the LIP. When we asked to see the unseen informal application we were told to write in and pay the relevant copying fee. Surely enough we did that then we are told that the correspondence does not come within the relevant PD so we need to make an application, paying £255 to see the correspondence in an on notice application.

So I ask again why on earth has this not happened before.
