The problem is indeed the CPR.
Woolf promised
1. A streamlined and much simplified procedural code
2. Which everyone (including non qualified) could understand. [This would include the complete prohibition of Latin. Anyone know what we now call a Res Ipsa case?]
3. Where all other rules would be subservient to the overriding objective such that
4. This would see an end to satellite litigation and procedural appeals
5. And an end to procedural case law and precedent because if the instant decision furthered the overriding objective then all else could be ignored.
What he delivered does not quite fit the bill really does it?
