And why shouldn't we "charge what [we] think we can get away with"?

Isn't that exactly what everyone charges for everything? Why are lawyers supposed to be subject to some kind of bizarre fixed price scheme? No one I buy anything from is expected to give me the lowest price by government or regulatory mandate.

It can only be right to fix our fees when Tesco agrees to give me my weekly shop for free, and my landlord has to have a fixed rent, and my car loan is written off...
