The whole disciplinary landscape for solicitors is ripe for review. For example, the theft of sunglasses from a shop whilst reprehensible is not in my view as reprehensible as the theft of tens of thousands from a deceased's estate. Just to look at one issue. We are no longer a society that sends convicts to Australia as punishment and the solicitors profession has failed to move on and look at dealing with matters proportionately. A debate needs to be had. The reason it does not happen is self interest. Look at the Clifford Chance agreed outcome, does the partner involved in that case have !ore integrity than the the person who stole the sunglasses. Society has moved on but theLaw Society and the SRA have not. Why because those involved in those organisations like Clifford Chance are pretty much protected- self interest.
