I think that this does need to be litigated so that all other members of staff know when can, (in reality effectively with good Counsel that they will be able to), safely release important public interest material such as who is starving the public of investment money, to the press.

Its good that the Appleby Group care so much as to get the grounds for release finalised so concretely.
