I was formerly ambivalent about ADR / mediation. In my own experience it seemed an uneccessary layer of expense which had failed to deliver results. What has changed however is the decimation of HMCTS. Why should my clients put up with extortionate costs, inordinate delay and Judges who are frequently unprepared due to overwork and sometimes rude and dismissive of clients and their advisors? The alternative is a professional well paid motivated mediator. What I think we are seeing is the partial privatisation of civil justice via the back door cloaked under the austerity umbrella.
