Well: there's a breath or common sense. The present law means that every marriage is the subject of a declaration before a public official (under criminal penalties) that the parties are free to marry - in the English sense - and is also the subject of a certificate in a common form which is familiar to courts and government departments and councils and the public. And a good thing too.
