I welcome these proposals which are well overdue but can I just remind non- Muslim solicitors advising women who have an unregistered ‘Muslim Marriage’ that those women do have more financial rights than the average ‘common law’ wife has under British law if they make a claim under Sharia law.
Further, Muslim women who are wealthier than their husbands have distinct advantages over their husband if their marriage is unregistered.
It may be imperfect but in these cases it is certainly not a ‘forged cheque’ (anon 14.48) and should not be overlooked.
