I’m going to wait and see how this plays in tomorrow’s press. I’m guessing that it won’t be good.

Average litigants with good cases have problems in affording a lawyer. Even more if the case is not clear. I was once involved in a case where a litigant had been let down by 3 firms of solicitors. He still lost.

In the day of the Rules of the Supreme Court and the County Court Rules there was a deal of judicial discretion. The White and Green Books were mainly devoted to explaining it. This was thought to be a bad thing. Hence CPR as the all singing and all dancing panacea. The books haven’t got any shorter.

I agree with the result. The minority controls the debate.

There will be revision to help LIPs. As to the consequences, watch this space.
