I don't know where I stand on this decision, I can see the strength of the arguments on both sides so I will leave it to others to argue the rights or wrongs of it. My practice is in Crime so I can thankfully ignore the CPR.

What I find distasteful however, is the almost gloating tone of some of the comments here about how LiPs bring it on themselves if they choose to engage in litigation without a solicitor, as if it is a choice and that they deserve to have a bunch of very clever people use a very clever, unfamiliar system against them.

By all means argue that this particular Claimant was at fault. By all means bemoan the lack of public funding in civil matters; the needless bureaucracy; the way that it is harder and harder to make a living in most areas of law but let us not demean ourselves by revelling in schadenfreude at the expense of LiPs
