I agree.

In a post on another matter yesterday, a commentator wrote: "Although with a LiP compromise is almost beyond possibility anyway."

That is a real issue. I have recently been through a 12 day Trial (acting for Claimants against two Defendant LiPs) which was set down for 4 days, but had to be extended twice when the Trial hopelessly overran (as I had warned at a CMC would in my opinion be inevitable).

I had considerable sympathy for the Trial Judge who not only kept his cool in the most trying of circumstances, but also was scrupulously fair to the Defendants, explaining relevant points at every step - a fine line in itself as my Claimant clients considered that he was being blatently biased, my explanations notwithstanding.

All attempts at settlement, compromise, or mediation, had failed, the Defendants having flatly refused to consider any such, a point that appears to be common ground with most LiPs I have experienced.
