Since purely on the numbers, (68/9 at appointment) Lady Hale must have been given an extended contract/ deferred retirement to take on the Presidency of the Supreme Court.
What is sauce for the goose must be sauce for the gander and, given that retirement can now only be forced for capability reasons, perhaps we need to re-think compulsory retirement at 70 for judges. Particularly as there seem to be recruitment issues.
Sir Rupert is clearly being retired against his wishes, and come July I would have money on the position for Sir James Munby being identical.
Seventy is not what it was when (I think it was Churchill) had to recommend to the sovereign that a judge be retired on health related capability grounds.
