The 'no settlement before medical evidence' bit doesn't have very many teeth, does it? Each regulator makes up their own rules about it (whose regulator do we think will be the most zealous?), and it isn't a criminal offence or breach of statutory duty to breach the provisions, and it doesn't render the settlement void (or even voidable).

So the same cold-calling cowboys with no oversight are going to be going round brokering crap pre-med settlements, because lawyers can't advise on them, and the poor claimants will be stuck with the crap deal regardless.
