The parties having the same conveyancer is happening right now at every volume licensed conveyancing shop in the country, as their code of conduct permits this and they take full advantage.

Referral fees being banned is a must, as estate agents exert enormous pressure on clients to use their "preferred conveyancer" *cough*whoeverwillpaythemost*cough*, so advertising budgets while that nonsense is going on only goes so far.

The biggest problem with conveyancing is estate agents getting involved in the process. A process they have no role in, and no qualifications to have a role in. Estate agents are supposed to broker the sale and then sit quietly while the conveyancers deal with the legalities. In practice estate agents go so far over the line it's ceased to be a joke. They try and get involved in the replies to enquiries, give incorrect legal advice to the parties when an issue is discovered, and cause a mad panic of delays and threats to withdraw on all sides when they discover a solicitor hasn't dealt with something as immediately as they'd like. They are the true menace of the conveyancing industry.
