Yes, but as the judgment says (para 111):

"What on its face looks like a general policy which applies to everyone equally may in fact have an unequal impact on a minority. In other words, to treat everyone in the same way is not necessarily to treat them equally. Uniformity is not the same thing as equality."

The judgment was referencing Jakóbski v Poland, where a prison diet did not take account of a prisoner's Buddhist beliefs against eating meat. Everyone received the same food, so it was equal. But with no allowance for religious beliefs, it amounted to discrimination.

Here, the fact is that delays in releasing bodies for release causes disproportionate distress to some families due to religious beliefs. A delay of a few hours may be a minor or non-issue for some families, but of huge concern to others.
