If you are a busy NHS consultant and not particularly versed in law, and are asked to give a witness statement, you will be asked questions by reference to the history provided from the notes etc. You may or may not appreciate that gaps in the questions may be critical.

It is not so easy to say that the defendant withheld evidence when you do not know what the statement proofing exercise was and in fact the witness (and by extension the defendant) may be completely blameless in this. It is the question you don't ask that creates the biggest trial headache.

The defendant should perhaps be looking at their representatives to ensure this sort of thing doesn't happen again. Overall it's a pretty fair result because the people who appear to be at fault won't get paid as much.
