I am not a solicitor - nor had any legal training (and in case you're wondering, no I've never been on the "other side" and been in custody) - so how come I can see why this would be so wrong?

Was he naive? I don't think so. His action (or, more accurately, inaction) when he overheard what the suspect was saying on the phone, makes me wonder if there had been more to this.
