anon @ 15.59 - from my point of view, they would be in the same position they always have been, i.e. judged as to the reasonable standards to be expected of someone in their position.

Save of course for the clerk behind the counter and the newly appointed judge, as they basically get a free pass...

Again, in my view this is not opening up a can of worms, but singling out an area where it is said the usual rules don't apply. The Defendant's argument was not to challenge the usual rules (negligent misstatement etc...) but to say this was a novel area so they shouldn't apply.

There are lots of other control mechanisms, and I just don't see that it is necessary to deny that receptionists in A&E owe a duty to patients not to give misleading information.
