I have known genuine clients' accused of FD give up their cases simply because of the allegation and the very real fear of all the costs and the smearing of their reputation. It would also seem that the allegation is used quite liberally to induce such an action. Equally, I know of a genuine claimant who was found FD simply because the other driver did not tell the truth at the hearing. Similarly, I know of one well-known insurer who turned a blind eye to the phantom passengers of children and spouse, ignoring their own client, who could show the TP driver was the cause of the RTC, but just accepted liability as it was cheaper than going to Court to fight it! So, all in all, there appears to be a prevailing attitude that all who claim are fraudsters and shame on them for having the audacity to claim, coupled with insurers protecting their profits in the smaller valued cases. There does need to be a balance with the detection and prosecution of those who perpetrate such fraudulent and dishonest activity with those who are genuine.
