Anons 9.37 and 10.24. Thank you both. I’ve had a stab at the long and detailed judgment.

As I understand the retainer CFA gave a wide margin of discretion. The solicitor honestly assumed that he had it. The end results were within proper margins for the damages agreed. The tribunal questioned his wisdom in doing what he did.

In other words, he did what he honestly thought was right for his client. If he was wrong then it was for his client to complain. Hard to see what about if the end result was a good one. It was not an SRA problem.

It’s going to be hard if doing your entirely honest - but maybe unwise - best lands you in front of the SDT.
