Read paragraph 13.54 of the judgment. Apparently, the solicitor (not the client) has control in a CFA case, because if the case is lost the solicitor doesn't get paid. "Solicitors could not be forced to continue such cases when there was an offer which ought to be accepted".

Erm, what? If an offer which should be accepted is made but the client cannot be located in order to get instructions from him, the answer is surely not to accept the offer in order to "get paid". The answer is to come off the record.
