I work on both sides of the fence and try to be objective.

DJ's and Deputy District Judges are far too slow to make findings of FD, I have seen case after case where the claimant loses on 'causation' when the natural inference is that they have lied and yet no finding of FD.

I have also dropped numerous cases where FD has been raised either directly or obliquely or taken a lowball over which is as good as an admission.

s.57 is working and most claimant lawyers would prefer a more robust and consistent approach by the Courts, after all we don't want to pay for a hearing fee + counsel to see the whole thing going south.

If insurers wanted to assist in stamping out fraud they would make early disclosure to the claimant of their engineering evidence so as to demonstrate the damage to the defendant's vehicle. In a portal case if we get photos in which show no damage to the D's car then we're going to be reluctant to listen to the client who stretches reality.
