It is impossible to gauge the extent of the unfairness being complained of here without the full facts and stats of every case. It is consequently difficult to know if the system is actually flawed or not and it is also difficult to know what is being sought by way of resolution ? "More backing" apparently. I'm not sure what that actually means.

If the system we have is flawed, the flaws impact all parties and not just Defendants and insurers.

Take the Autofocus case (https://www.lawgazette.co.uk/news/defendant-firms-in-126m-credit-hire-claim-to-face-october-2018-hearing/5061416.article) - this is a good example of how sometimes it takes a higher Court to expose dishonesty.

In Autofocus, thousands of cases went to trial and lost at first instance because the Defendants so called experts fabricated their evidence.

It seems to me that there isn't any particular change to the Court system which will extinguish the common cause of the problem i.e dishonesty.
