It will be interesting to see how the BTE legal expenses insurance market, which is mostly sold when customers take out their compulsory motor insurance policies, will respond to the increase in the small claims limit. Many people rely upon their legal expenses insurance to enable them to have access to justice. I strongly suspect there will be an increase in BTE premiums. Hopefully, the increase will be nothing like the current ATE premiums quoted.

Or perhaps there will be changes in BTE policy wording to exclude personal injury claims that fall within the small claims limit?

Or perhaps BTE insurers will continue to fund the claimant’s small claim arising from a road accident against the insured negligent third party because of the profits that are made by encouraging a policyholder to take out a credit hire vehicle?

A world leading legal system based on a civilised Tort system should continue to enable a wronged person to seek redress for their pain and financial loss. The system also helps to prevent the tax payer from subsidising the state benefits paid and the cost of NHS treatment arising from the negligent acts of road users.

Less speed and extra care in more than one sense of the word.
