When I was in private practice, many clients simply did not want "no fault" divorce and insisted that the othe person was the "guilty party". Often attempts to achieve an amic@ble outcome would be met with comments such as "I thought you were meant to be on my side".
Perhaps the way forward is not towards "no fault" divorce but to adopt the Hong Kong divorce law. This is based on English Law but the periods of separation are reduced to 1 year (with consent) and 2 years ( without consent) as opposed to 2 and 5.
I am old enough to remember that when the DRA was first introduced, the 5 year ground was feared by some to be a "Casanova's Charter". This has not proved to be the case and reducing the 5 years to 2 ( or even 3) would help people like Mrs Owens.
