Anon at 8.04 - claimant lawyer by any chance? what complete nonsense!

There are plenty of claimant firms (large and small) who run most of their claims to trial by doing barely anything but minimum work required to meet case management deadlines. The defendant makes a Part 36 offer - sometimes more than one - in an effort to manage costs and resolve claims early and is met with silence. At the last minute, before the claimant has to incur any counsel's fees for trial and incur costs preparing a bundle, there will be a last minute acceptance of the defendant's offer. The defendants, who know they will recover nothing, have little choice but to take the economic solution for the client, despite having incurred significant unnecessary cost.

There is plenty of game playing on both sides, claimant lawyers should put the violins away, you sound ridiculous.
