It seems that what is being propounded - at least by a significant number of those commenting here - is that there should be a 'common law' for solicitors and the SRA and the SDT should be the police and judge of that. That is that which I find worrying. I find Ms Daniels' tweets offensive. However I'd find it equally offensive if she tweeted that all non-vegetarians should be force fed exclusively on a diet of quinoa. But I don't believe that the SRA or the SDT should take action against a solicitor making of either of these offensive remarks because they are not in breach of the criminal law. They may not be PC but they are not illegal. If society finds Ms Daniels' tweets so offensive it should be lobbying parliament to change the law in order that such remarks are criminalised. It should not expect or require a professional regulatory body to fill what it considers to be a legislative lacuna.
