Ex-spouses chose their spouses, didn't they? If you are running an SME which owes you money you will regard your debt as more important than that to the ex-spouse and you will be right. That is why if one of two married home-owners goes bankrupt in the end the house has to be sold with vacant possession; that is why a creditor with a substantial charging order will get an order for sale; that is why if a single person buys a house on mortgage and then gets married (so that the spouse's name is not on the deeds) and defaults on the debt sale must follows. It's all an application of the expression "for better, for worse, for richer, for poorer" which is the foundation of all marriages, not just those celebrated by the rites of the C of E.
