Having spent a bit of time in some regulatory tribunals, I would point out that they don't tend to order costs to be paid by the registrant. Seems to me the fair choice is either balance of probabilities and no SRA costs or beyond reasonable doubt and be liable for costs (to be properly assessed) if found guilty.

Personally, given the general conduct of the SRA, I'd rather stick with the current standard of proof.
