Surely, there can't a general rule that documents disclosed to the defence are disclosed on the basis that they can't be used to further the case? One can envisage circumstances where the viewing of certain documents and reports might need a direction from the court (or agreement) as to how they are to be used, but that would be the exception, rather than the rule.
