If Leigh Day's costs were over £8M and these were paid by D&O insurers, then whether Leigh Day won or not, there will be inevitable repercussions in the D&O market and the Solicitors PI market if these levels of costs are being run up. Lloyds took a hit last year on E&O generally and the word is that rates will be hardening for all E&O, D&O and Solicitors PI. Some firms will find their activities curtailed or premiums simply unaffordable, whether E&O or D&O. There's a limit to what the market can take and by all indications, we've reached it.
