There are no "protections" under the "new regime". If you were involved in the wrongdoing, you're at risk of being prosecuted, even if (a) you were very junior and (b) you were the person who reported it to the SRA.

What the James and Scott cases show is that the SRA is not inclined to demonstrate any judgment/discretion in deciding whether to prosecute the junior person. It is certainly not inclined to do anything to protect that person. What the SRA has failed to realise is that adopting such an inflexible stance is likely to deter solicitors from reporting misconduct.

Ms Clowrey should ensure that she raises her concerns with the LSB as well as the SRA.
