I am commenting as chair of the Solicitors Assistance Scheme (SAS).

I agree that the SRA must look at this situation urgently, particularly its policy on whistle-blowing which has not been updated since 2012. I think the decision to refer to the SDT was particularly harsh in the Scott case.

I also think that we should adopt a 'fitness to practice' regime which could see an end to decisions of this type by the SDT.

However, I also have a practical point I would like to make.

Although it is a long time since I qualified I well remember being in situations where I really didn't know what to do and where I could easily have made a wrong decision. I was very fortunate in that I was in a good firm where I could seek advice and support.
Not everyone is so lucky.

These are tragic cases and I wish that Ms James and Ms Scott had known that there were people willing and able to help at the time their problems first began.

The SAS are solicitor volunteers who give free advice to solicitors, trainees and anyone working in the legal field.
I would urge anyone who finds themselves facing a difficult decision to call us when the situation arises. The advice given will be in confidence and you need not give your name if you do not wish to. We can give an outside perspective and advice.

It is heartbreaking to receive a call from someone who is already facing disciplinary action and to hear them say 'if only I had spoken to you sooner'.

I would ask all readers to publicise the help available whenever they have the opportunity to do so.
