Aren't we missing the point here? A criminal record is only created by a conviction for a recordable offence , that is an offence specified in "The National Police Records (Recordable Offences) Regulations 2000" which is any offence carrying a term of imprisonment or listed on the schedule to the regulations, only traveling on a railway with intent to avoid payment carries imprisonment, the most commonly used offence is in fact "failing to produce a valid ticket" which only carries a fine and as far as I can see is not on the schedule. As no photograph, fingerprints or DNA are taken it would also be a little difficult to be satisfied who was convicted. So no criminal record on PNC or at the barring service. The same as speeding which is also a conviction in a criminal court but not recordable.
