The problem here is that there are many shades of grey. The employer is unlikely to say, "we've been sexually harassing her and we want to bribe her to shut up. Please draw up the NDA."

It's likely to a be a bit more subtle. The head of legal trots out this pitch:

"The CEO has been having a bit of a fling with his PA. It's over now because he refused to leave his wife. She's threatening to go the tabloids with lots of sordid stuff, but she basically just after the money and she's agreed to keep her mouth shut in return for £200,000 and her company BMW. The CEO is desperate to keep his marriage together and we'll deal with the money by reducing his bonus. Please draw up the NDA."
