Sorry, anon 17:33, but I do not agree. We are the lawyers. It is our job in any field of law to explain to our clients what the law is, what the risks are and how to avoid or mitigate or minimise them. Admittedly there is perhaps little you can do to mitigate or minimisse risk in the everyday domestic property market, but undoubtedly you must explain the legal consequences of what your client is doing. When the clients decides whether and if so what to do, we provide the mechanisms to do it. You cannot to that without first ascertaining the client's aims, the law and the risks.
