The biggest problem here (I have been observant in UBER-Law since at least 1995), is that the 'Profession' wanted (as ever and as any capitalist driven entity) , to maintain high fees (commendable if it continued to be 'learned') but if for their not so bright Public School 'educated' partners (and 'Chums') not so commendable (the ones who I can honestly report though through hearsay of Trainees etc, were frantically scouring their Library for a Swot Text on Company Law at the last moment).

They needed a source. The Joe P., had smartened up and were more savvy.

Where then to go?

Obvious answer. They were hitting the Insurance 'Industry' (still a 'Profession' at the time perhaps?), hard. The Paralegal Factory - Green Form lead in - Legal Aid Certificate - Cancellation - Scale 1 Fee - scam was still in its infancy.

Bingo! Access to (In)Justice Act 2000!

We'll let Insurers in on the flogging of 'policies' (even though Joe P. usually had a Legal Expenses Policy (a.k.a., as Market Capture Vehicle for PI and Employment Claims), already and was covered by the Legal Expenses Insurance Directive 1990), and worry about the payment of those extortionate 'fees' later.

The when the rules against Maintenance and Champerty go, and ambulance chasing advertising then becomes the norm .....

A perfect storm for everyone in the business ....

We can get out of it though I should have thought and the SRA and Law Society have I suspect now woken up ...
