The PI claims system is without doubt very vulnerable to claimants lying about their condition. In the past perhaps there wasn’t so much of a problem but with PI turned into a huge industry with CMCs, factory firms, medical agencies, hire car companies the problem of fraud is becoming more pressing. It is not a victimless crime -the poor will disproportionately suffer more from higher insurance premiums. I’ve no answer to the problem other than perhaps very stiff jail sentences to those caught lying which would send the message that claimant fraud is a serious offence
