ADR misses high road

Alternative dispute resolution (ADR) is currently focused on larger value and more complex disputes (see [2001] Gazette, 28 June, 1).

I suspect that many high street firms continue to be slow in adopting mediation and other ADR methods.I receive instructions from small businesses with disputes falling within fast-track values.

These often result in litigation.

If there were a viable alternative then I would be advising my clients of it and pursuing it with them.

But I have yet to experience a matter being referred to ADR by the court.Indeed, ADR and, especially, mediation are not particularly suited to high street work - and the first choice of most high street solicitors and their clients will remain litigation.

I think it unlikely that the high street can assist with the dispute resolution revolution.
