It is difficult to express on paper the extent of my dismay to Henry Bermingham's comment piece. It appears to be nothing more than an attempt to resurrect the old compensation-culture debate - a debate from which most parties involved in the compensation process, including insurers, have long since moved on.

Making sweeping generalisations and re-enforcing alarmist newspaper headlines does nothing to alleviate teachers' fears of litigation. What is needed is a serious debate to highlight the difference between an accident and negligence, and how to avoid the latter through sensible assessment and management of risk.
