I have just come off the telephone with an anxious client regarding lasting powers of attorney and Court of Protection applications.

I was concerned to hear that a manager from NatWest had told a client of mine that I had incorrectly completed a Court of Protection application and should have completed a lasting power of attorney.

The lady in question was a resident of a nursing home and, having met her twice and for two lengthy appointments, I was in no doubt that she could not have the sufficient mental capacity to understand her estate nor an LPA.

However, the bank manager assured my client that there was an LPA for mentally incapacitated people.

I would question the level and quality of training of staff members who are clearly trying to advise lay people. Sadly, it has been my experience that banks rarely understand the process and this has caused severe delay in some of my matters.

Even trying politely to inform the bank of the issue and danger of fraud left me with a bad taste in my mouth.

I was put through to a support team member on a nationwide number who dutifully took note of my concerns but gave no assurances or indication that anything would be done.
