How depressing to see so many of my fellow solicitors remonstrate against the new lasting power of attorney (LPA).
The fact of the matter is that the old enduring power of attorney (EPA) had been the cause of the widespread financial abuse of vulnerable adults (one third of EPAs, according to the former master of the Court of Protection).
While the LPA may not be perfect, at least it offers greater protection for adults who lack mental capacity and this should not be dismissed in such a cavalier fashion by solicitors.
In my experience, the LPA does not take much longer to complete - so long as the solicitor has a solid grasp of the main issues.
