I do not find compelling the argument by the Law Society President regarding the Solicitors Indemnity Fund (SIF) surplus (see [2006] Gazette, 2 February, 14).

If the Law Society had the right to demand the payment of the supplement to the SIF, then the Law Society should be responsible for repaying it. The profession had no choice in the matter, so it is somewhat disingenuous for the Society now to say that the SIF is not a mutual fund and there is no legal right to the return of contributions.
