In a recent 'Question of Ethics' column, (see [2005] Gazette, 9 June, 32), it was said that the Law Society does not regard unsolicited e-mail or text messages as a breach of the publicity code. However, it should not be overlooked that unsolicited e-mail or text messages to individuals may be unlawful under the Privacy and Electronic Communications (EC Directive) Regulations 2003.
